Bessent Floats “Unprecedented” Affiliates Rule Suspension, Global Investigations Review

Partner Michael Huneke spoke with Global Investigations Review about the statement by Treasury Secretary Bessent that the United States would suspend the Bureau of Industry and Security’s new 50% export control rule.

Mike noted that the rule “seems to have had some value in the trade negotiations” and “was viewed at least by our administration as a counterweight to the rare earths controls and strategic minerals controls that the Chinese government had put out.”

“Everyone should expect the administration will see this as something that gave it value, and so they’re not eradicating it from the rules. They’re just suspending its application, and so it very easily could be snapped back,” Mike said.
