Act as if BIS Affiliates Rule Is Still On: Experts, The Export Practitioner

The Export Practitioner quoted partner Mike Huneke in an article about the United States suspending the Bureau of Industry and Security’s recently imposed 50% Affiliates Rule.

“In-house trade compliance professionals should be sure to communicate to their internal stakeholders that the suspension of the Affiliates Rule does not otherwise modify the baseline anti-diversion regulations in the U.S. Export Administration Regulations, all of which are unaffected by the suspension and many of which turn on ‘knowledge’ defined not only to include ‘actual knowledge’ but ‘an awareness of a high probability,’” Mike told the publication.
