Impact of the Shutdown: What Happened, What’s Next for CFIUS?, Foreign Investment Watch

Foreign Investment Watch quoted partner David Plotinsky in an article looking at the impact of the federal government shutdown on the activities of the Committee on Foreign Investment in the United States (CFIUS), and what to expect now that the shutdown is over.

Speaking to the longer-term impacts of the shutdown, David noted that “parties and their counsel should give additional thought to the chance of a government shutdown when negotiating deal deadlines, so that deal deadlines allow time both for CFIUS review and also potential lapses in appropriations.”

“I advise clients to factor potential government shutdowns into deal timing, and that planning can take various forms,” David said, “such as negotiating a later deal deadline, or at least allowing extensions if needed to obtain regulatory approval.”
