Analysts: Tariff Fights Will Continue in Courts, Congress After High Court Ruling, Inside U.S. Trade

Partner Casey Weaver spoke with Inside U.S. Trade about the expected decision from the US Supreme Court regarding the Trump administration’s use of the International Emergency Economic Powers Act to impose tariffs.

Casey noted that a decision overturning the tariffs would likely lead to litigation over refunds for duties already paid, as many companies have already filed suit in the Court of International Trade. What happens next in those cases “will depend on whether litigation is required; there could always be an administrative process” for refunds, Casey said. If refunds do require new litigation, Casey told the publication, “I think we can expect consolidation.”
