ITC Commissioner Nominations Could Create a Republican Majority, IAM

Partner Matthew Rizzolo spoke with IAM about the status of commissioner positions on the US International Trade Commission, three of which have been vacant for a year.

Matt explained that having only three of the six commissioner positions filled meant that each commissioner’s individual vote carries outsized importance in an investigation.

“If someone has to recuse themselves for some reason and there are only two, that increases the potential for tied votes. If you had two recusals, you’re left with less than a majority of commissioners in office. That does have the potential to halt an investigation,” Matt said.
