Supreme Court Shoots Down ‘Emergency’ Tariffs, But Trump Can Pull Other Levers, Dow Jones Risk Journal

Morgan Lewis partner Michael Huneke was quoted in Dow Jones Risk Journal discussing the implications of the US Supreme Court’s decision limiting the use of the International Emergency Economic Powers Act (IEEPA) to impose tariffs.

“It’s a lot easier for the US to just try to encourage that behavior through a secondary tariff,” he told the publication, highlighting potential operational challenges associated with identifying and sanctioning individual foreign entities.
