ITC Opens More Infringement Probes Into New IP Matters, Law360

The article reports a rise in cases tied to IP not previously litigated at the ITC, with potential drivers including recent federal circuit guidance and evolving US Patent and Trademark Office practices.
Stephanie explained that a key appellate decision expanding what qualifies as domestic industry may be encouraging more companies to bring claims before the ITC.
“I think the broadening of the expenses that can be considered in domestic industry is helping drive entities to the ITC where they maybe wouldn’t have gone before,” she said.
