SEC Enforcement Manual Overhaul Signals a New Era for Firms Under Investigation, Pensions & Investments

Pensions & Investments quoted partner Carolyn Welshhans in an article about recent updates to the US Securities and Exchange Commission (SEC) Enforcement Manual. Carolyn discussed which changes she thought would make a big difference.

Carolyn noted that one particular update encouraging enforcement staff to send termination notices to more parties to alert them of an investigation’s conclusion was a positive development.

“That’s new, and I think that’s helpful, because even if a company understands it may not be the focus of the SEC investigation, it can still be really expensive and time consuming to be making these productions,” she said. “And to know they’ve come to an end, you can plan your budget accordingly going forward.”
