Trump’s Pipeline Order to Test Limits of Cold War-Era Authority, Bloomberg Law

Partner Ella Foley Gannon was quoted in a Bloomberg Law article examining the legal implications of President Donald Trump’s executive order directing the restart of a dormant California oil pipeline under the Defense Production Act (DPA).

Ella noted that a Department of Justice memorandum issued before the order was signed outlined several legal pathways for the administration to justify federal preemption of state law, highlighting the unusual sequencing of events leading up to the directive.

“They’re really laying the stage out to give as many tools in the toolkit to the executive branch as possible,” Ella said.
