The Capitol Forum quoted partner Joshua Goodman in an article examining how a potential Democratic House majority following the 2026 midterm elections could increase coordination between congressional investigators and state attorneys general on antitrust enforcement matters.

Josh discussed how congressional hearings and investigations can amplify public scrutiny around mergers and alleged anticompetitive conduct, potentially encouraging additional state enforcement activity and supporting related private litigation efforts.

“That public dynamic can create a feedback effect that may spur some states to act,” Josh said. He also noted that congressional investigations can aid private plaintiffs because “Congress can potentially do a lot for them because they don’t have pre-complaint discovery tools.”
