Midday Remote Work Just Got a Boost, SHRM

SHRM quoted partner Russell Bruch in an article examining a recent US Department of Labor (DOL) opinion letter concluding that, in certain circumstances, employees’ midday travel between home and the office is not compensable under the Fair Labor Standards Act.

The article explores how the US DOL’s interpretation could give employers greater confidence to offer flexible remote work arrangements for nonexempt employees. Russell emphasized that the ruling is limited in scope, noting, “The opinion letter did not decide that all midday travel is noncompensable” and that longstanding rules governing travel between worksites, work performed while traveling, and employer-directed travel remain unchanged.
