Could Climate Change Lead to Increased FMLA Use? Attorneys Are Afraid So, HR Dive

Of counsel Pierce Blue was quoted by HR Dive in an article examining how climate-related hazards and extreme weather events may lead to increased use of leave under the Family and Medical Leave Act (FMLA) and create additional compliance considerations for employers.

Pierce discussed how climate situations could contribute to an increase in chronic health conditions and that employers should maintain appropriate medical certifications and train managers to recognize situations that may implicate the FMLA. “I don’t think the training needs to be super intense or that managers need to have a clinical knowledge of the FMLA,” Pierce said. “It’s more important that, if somebody says they need time off for a medical reason or to care for their children [...] know that that could be FMLA and that you should be looping in HR or legal.”
