US State AGs Flex Their Antitrust Enforcement Muscles, Commercial Dispute Resolution

Partner Joshua Goodman spoke with Commercial Dispute Resolution about the increasingly prominent role of state attorneys general in US antitrust enforcement, including their focus on pricing practices and use of outside counsel to expand enforcement resources.

Josh noted that state attorneys generals’ prominence in antitrust enforcement has been increasing “over the past decade” and has become “supercharged” in recent years.

He also pointed to pricing as an emerging area of scrutiny, noting that “issues related to pricing, including algorithmic pricing, may potentially raise either antitrust concerns or consumer protection concerns about personalized pricing.”
