Morgan Lewis Obtains Federal Circuit’s Affirmance in Milwaukee Electric Tool Corp., Techtronic Industries Battery Pack Patent Matter

CHICAGO, February 21, 2018: Morgan Lewis has secured affirmation of the validity of foundational patents on high-power lithium-ion battery packs developed by Milwaukee Electric Tool Corp. from the US Court of Appeals for the Federal Circuit.

Over the course of three years, Milwaukee Electric Tool Corp. and Techtronic Industries faced 12 inter partes reviews (IPRs) from five competitors alleging that the patents for the battery packs were invalid. The Federal Circuit consolidated the appeal from each of the 12 IPRs, and on February 16, Judges Jimmie Reyna, Raymond Chen, and Richard Taranto affirmed the US Patent Trial and Appeal Board’s holding that all of Milwaukee Electric Tool Corp.’s and Techtronic Industries’ foundational patents on high-power lithium-ion battery packs for power tools are valid.
