This article analyzes a recent rent control decision out of the State of New York, finding that a rent-regulated lease was exempt from creditors in a bankruptcy proceeding as it was classified as a local public assistance benefit. The article then analyzes whether California’s rent control cities may follow this decision given California’s social and economic policy reasons for adopting rent control.
