US Supreme Court: No Consent Requirement for Sending Unsolicited Text Messages, MMR-Aktuell

Calls from "autodialers" are a nuisance to many in the USA as well as in the EU. At the beginning of April 2021, the long-awaited high court judgment of the US Supreme Court in the case Facebook, Inc. v. Duguid (U. v. 1.4.2021 - No. 19 -511) on the scope of the definition of an autodialer in the Telephone Consumer Protection Act (TCPA). The court unanimously restricted the application of the TCPA to systems that either store a telephone number or generate a telephone number using a random or a sequential number generator indicating the judges strict statutory interpretation of the wording of the law, largely in favor of Facebook.
