The latest supplement addresses Supreme Court decisions on the FCA’s scienter element and the US Department of Justice’s dismissal authority, as well as other recent developments—from the Sixth Circuit’s determination that plaintiffs must demonstrate “but-for” causation in Anti-Kickback Statute–based cases to the updating and expansion of several states’ false claims laws.
