The article discusses whether existing FRAND standard essential patents licensing case law can adequately inform FRAND determinations when applied to digital platforms, as well as issues and questions to consider when FRAND principles define terms for third-party access to digital platforms, and what characterizes a balanced approach that satisfies party interests.
