Ninth Circuit Partially Tackles Open Issues in Customs-Based False Claims Act Cases, Washington Legal Foundation
October 06, 2025Partners Doug Baruch and Jennifer Wollenberg co-authored an article for the Washington Legal Foundation analyzing the Ninth Circuit’s recent decision in Island Industries, Inc. v. Sigma Corp., in which the court ruled that customs-based False Claims Act cases can proceed in district court and are not preempted by customs law.
The authors noted that the decision eases procedural hurdles but leaves key questions unresolved for importers.
