Mark A. Feller
Mark A. Feller is a trial lawyer who practices civil litigation in federal and state courts with experience in a variety of areas, including consumer and securities class actions, shareholder disputes, and environmental litigation. He also litigates commercial and consumer disputes before arbitrators. He advises clients in the automotive, technology, and oil and gas industries throughout the United States, including in California, Texas, Florida, Delaware, and Colorado.
During law school, Mark served as a judicial intern for Judge Nancy F. Atlas of the US District Court of the Southern District of Texas in Houston. Within the first several years of practice, he participated in a volunteer prosecutor program where he tried eight jury trials to verdict in Texas state court.
Mark has an active pro bono practice and has advised indigent clients in obtaining divorces, expunging criminal records, pursuing legal immigration status, and vindicating constitutional rights through Section 1983 suits against law enforcement officials.
- Served as lead trial counsel in two-week federal court jury trial for an incarcerated person who brought claims for constitutional violations against prison guards for the use of excessive force
- Defeated certification of a nationwide class for an automotive distributor facing allegations that a defect in the design of the HVAC system of more than 7 million vehicles purportedly resulted in foul odors and health hazards; obtained dismissal of a similar alleged defective HVAC system design in a different model vehicle, leading to the favorable settlement of two additional proposed class actions
- Represented asylum seeker before the US Court of Appeals for the Ninth Circuit; prepared successful briefing and presented oral argument before three-judge Ninth Circuit panel
- Successfully compelled consumer class action to arbitration on an individual basis, preventing costly discovery and potential class damages exposure for a technology company
- Served on trial team during a two-week bench trial in the Delaware Court of Chancery, and all causes of action against represented parties, including former chief executive officer, president, general counsel, chief financial officer, and board members, dismissed
