Partner Ron Dreben spoke to Managing IP about a New York jury siding with Hermès in a trademark dispute over MetaBirkin non-fungible tokens (NFTs). Ron said the verdict—which found that artist Mason Rothschild infringed on the company’s trademark—could be hard to overturn on appeal given the fact-dependent nature of the case and the judge’s discretion about admitting evidence.
