Benjamin B. Anger
Ben Anger is an intellectual property (IP) litigator whose practice focuses on utility patents, design patents, trademarks, trade dress, unfair competition, and breach of contract. Ben counsels clients across a broad range of industries including life sciences, chemistry, medical device, and consumer products. Ben’s chemical engineering background and experience in consulting enhance his ability to serve clients in sectors such as life sciences, healthcare, and consumer product manufacturing.
Before joining Morgan Lewis, Ben was a partner at a national IP law firm. Ben also previously worked for multinational information technology and software development consulting firms.
- Obtained summary judgment of noninfringement on all patents-in-suit for medical device company involving collection device for PCR testing; successfully challenged the validity of related patents in inter partes reviews (IPRs) before the Patent Trial and Appeal Board (PTAB)
- Successfully invalidated five patents asserted against a medical device company’s nucleic acid preservation solution, including obtaining finding before the PTAB that patents were invalid for the patent owner’s egregious misconduct
- Successfully defended chain of museums against claims of trademark infringement, obtained dismissal of claims at the district court, and successfully defended victory before the Ninth Circuit
- Obtained a favorable settlement for a consumer products company through critical discovery wins in trade dress and design patent litigation
- Obtained a settlement for a medical device company in multi-patent litigation
- Obtained a favorable settlement for a medical technology company in patent litigation and PTAB proceedings
- Obtained a favorable settlement for a pharmaceutical company in patent litigation
- Obtained a favorable settlement for a healthcare company in patent litigation
- Obtained a settlement with licensing terms for a recreational equipment company in watersports systems litigation
- Obtained favorable settlement for a medical device company in patent disputes having resolved the cases through IPR proceedings
