David Fernandez-Fidalgo is a patent attorney who draws on his engineering background and US Patent and Trademark Office (USPTO) examiner experience to help clients strategically develop and protect global patent portfolios. He focuses on domestic and international patent prosecution, with an emphasis on maximizing IP value across a range of technologies. David prepares and prosecutes utility and design patent applications in diverse fields, including medical devices (e.g., orthopedic implants, drug delivery systems, surgical tools), smart speakers and displays, automotive components, business methods, software, and AI-driven inventions.
In addition to patent prosecution, David advises clients on freedom-to-operate analyses, non-infringement and invalidity opinions, and IP due diligence. Before joining Morgan Lewis, David served as a patent examiner in the USPTO’s electro-mechanical art unit, where he examined applications related to various medical technologies, including catheters, biopsy instruments, ventricular assist devices, deep brain stimulation systems, ventilators, ECG and EEG devices, plethysmographs, and pulse oximeters. Earlier in his career, he contributed to clinical research at the National Institutes of Health and Walter Reed National Military Medical Center, focusing on stem cell therapies, neuroimaging, and electrophysiology.
