Erin F. Rogers focuses her practice on antitrust litigation, government investigations, and counseling, including in healthcare and life sciences. She has experience with class actions, dispositive motions, discovery, and matters involving alleged price fixing, monopolization, tying, reverse payments, wage fixing, and other antitrust claims. Prior to joining Morgan Lewis, Erin clerked for US District Judge Mark Kearney in the Eastern District of Pennsylvania. In law school, she was a senior editor of the University of Pennsylvania Law Review and worked with Professor Herbert Hovenkamp.
- Defending a pharmaceutical manufacturer against class action antitrust claims arising from alleged agreements with generic manufacturers to delay generic competition.
- Representing a pharmaceutical company in litigation alleging anticompetitive conduct designed to delay generic competition for a pharmaceutical product.
- Defending a real estate company in an action brought by a state attorney general concerning the use of pricing software and nonpublic data to set rents.
- Defending an energy company in a putative class action alleging coordination of compensation and exchanges of wage information in violation of Section 1 of the Sherman Act.
- Represented a pharmaceutical company in expedited litigation seeking emergency relief in connection with a proposed acquisition.
- Defended a healthcare provider against a putative class action alleging that the provider and its clinically integrated network engaged in exclusive dealing, tying, and price fixing in violation of Sections 1 and 2 of the Sherman Act.
