Kevin P. Braun

Kevin has experience representing institutional investors in their lending arrangements with national sports leagues and teams, having represented institutional investors since 2008 in connection with their purchase of private placement notes under the NBA’s League-Wide Credit Facility and, since 2014, under the NHL’s League-Wide Credit Facility as to which he was involved in the initial structuring. Kevin also has experience representing hedge funds in connection with the purchase of aircraft and related financing arrangements.

• Legend Group — Counsel to institutional investors in a $160 million private placement of senior notes issued by an investment company with interests in computer manufacturing, Internet services and startup companies in China
• Hardwood Funding, LLC — Counsel to institutional investors in connection with the issuance of over $1.5 billion of private placement senior secured notes issued by one of the funding entities of the National Basketball Association, across numerous issuances
• NHL US Funding LP — Counsel to institutional investors in connection with the issuance of $410 million of private placement senior secured notes issued by one of the funding entities of the National Hockey League, an in connection with the initial structuring of the NHL’s League-wide Credit Facility
• Spirits of St. Louis Basketball Club, LLC — Counsel to institutional investors in two private placements of an aggregate of $525 million of senior secured notes issued by former American Basketball Association team with rights to broadcast revenues of certain NBA teams
• Xanterra South Rim, LLC — Representation of institutional investors in the $80 million secured financing of the special purpose entity which leases and operates the hospitality amenities on the south rim of the Grand Canyon. The basis of this financing is a Concession Contract between the special purpose entity and the National Park Service.
• Statnett SF — Represented institutional investors in US$330 million of senior notes issued by a Norwegian state enterprise that is responsible for high voltage electricity transmission and distribution in Norway
• Proquest Company — Aided holders of $325 million private placement notes in the restructuring of more than $500 million of debt of Proquest Company, which allowed the company to sell assets and prepay all debt in full with premium
• Idexx Laboratories, Inc. — Counsel to institutional investors in connection with a multicurrency note purchase and private shelf facility for the issuance of $200 million of private placement senior notes issued by a multinational corporation engaged in the development, manufacture, and distribution of products and services for the companion animal veterinary, livestock and poultry, water testing, and dairy markets
