Matthew D. Klayman

Associate

Matthew D. Klayman assists clients in a wide range of areas, including business and corporate disputes, class action defense, and appellate litigation. Matt has experience representing clients in all aspects of the healthcare industry, from health insurance, pharmaceutical, and medical device companies to the technology, financial services, food services, publishing, and manufacturing sectors. Matt has counseled clients through all aspects and stages of litigation.

Before joining Morgan Lewis, Matt served as a law clerk to Judge Thomas L. Ambro of the US Court of Appeals for the Third Circuit and Judge Gene E.K. Pratter of the US District Court for the Eastern District of Pennsylvania. While in law school, Matt was an articles editor for the University of Pennsylvania Law Review and participated in the Penn Law Supreme Court Clinic and the Third Circuit Appellate Externship. Prior to attending law school, he was the policy coordinator for an energy efficiency nonprofit in Philadelphia.

Class Action Defense

  • Secured denial of class certification and later partial summary judgment in nationwide class action challenging pharmaceutical benefits practices under ERISA and RICO (D. Conn.)
  • Secured vacatur and reversal of issue class certification decision and later complete summary judgment in class action alleging negligence and negligent infliction of emotional distress (E.D. Pa. and 3d Cir.)
  • Secured dismissal of class action against directors and officers of global chemical company alleging breaches of fiduciary duty in connection with the company’s $1.6 billion sale (Del. Chancery and Del. Supreme Court)
  • Secured dismissal of several class actions brought against camera manufacturer alleging product defects

Appeals

  • Representing a technology company in appeals from orders enforcing online terms and conditions and compelling arbitration  
  • Argued and briefed appeal securing affirmance of protection-from-abuse order against client’s former intimate partner (Pa. Superior Court)
  • Argued and briefed constitutional challenge to sentence of prisoner who received a lengthy prison term for crimes committed as a juvenile (Pa. Superior Court)
  • Argued and briefed appeal from summary judgment ruling in shareholder dispute (Pa. Superior Court)

Commercial Disputes

  • Defending pharmaceutical manufacturer against allegations of Anti-Kickback Statute, False Claims Act, and RICO violations 
  • Represented international publishing company and sports merchandise company in copyright infringement cases
