Torsten Kracht
Torsten Kracht represents US and international clients in complex commercial litigation and arbitration. He has served as trial counsel in jury and bench trials in numerous jurisdictions, and as arbitration counsel in major arbitral proceedings. Torsten works closely with clients to develop litigation strategies that effectively balance legal risk and business goals, leads internal investigations related to threatened or actual litigation, and counsels clients on strategies for pursuing claims in antitrust, contract and tariff-related opportunities. In addition to English, Torsten speaks German and Spanish.
- Represented a global energy trader, securing a full-sweep ICC arbitration, including defeating respondent’s counterclaims of more than $20 million and securing an award of fees and costs for the client
- Managed commercial litigation dockets for a multinational Fortune 100 company and a multinational Fortune 500 company
- Defended Fortune 500 entities in federal antitrust matters, including cases involving allegations of monopolization and attempted monopolization in the utility industry; bundled discounting in the healthcare industry; price fixing and market allocation in the food and polyurethane industries; and a unique case of exclusionary conduct in Mexico argued before Mexico’s National Antitrust Commission
- Represented US and international clients in international arbitration, including a US-based Fortune 100 company in a multibillion-dollar arbitration against an Australian counterparty that was presided over by the former Chief Justice of Australia’s Supreme Court
- Defended clients in product liability and mass tort actions
- Defended multinational clients in lawsuits alleging violation of biometric privacy laws
- Developed and implemented litigation and trial strategy for entities litigating related issues simultaneously in multiple US and non-US jurisdictions
- Led the development, documentation, and training of in-house lawyers on eDiscovery and litigation protocols
- Developed and implemented plaintiff-side and claims practices for corporate clients to aid law departments in generating revenue
- Obtained a $297 million RICO settlement on behalf of a healthcare network and others against a major US food distributor and its former non-US parent company
- Obtained a $22 million settlement on behalf of a class of healthcare providers and others in an antitrust case against a major global medical device manufacturer
- Obtained a multimillion-dollar confidential settlement on behalf of a military contractor against a prime military contractor for theft of trade secrets and breach of teaming agreement
- Developed award-winning litigation trackers to follow and analyze litigation patterns in discrete areas of law relevant to commercial clients, including COVID-19, public nuisance, and emerging technologies litigation
