Xiaoqian Zhou
Xiaoqian Zhou provides comprehensive advice on a wide range of labor and employment matters in China, covering issues throughout the entire employment lifecycle from hiring to termination and post-termination restrictions and disputes. Her practice encompasses general employment matters such as overtime compensation, working hours, and leave entitlements. In addition to noncontentious advisory work, Xiaoqian handles contentious employment matters including managing strikes and work stoppages and employment disputes, collaborating with local counsel on labor litigation. She also assists with immigration matters.
Xiaoqian’s practice also focuses on conducting cross-border internal investigations, representing multinational companies in matters involving US Foreign Corrupt Practices Act (FCPA)/anti-bribery and anti-corruption investigations, fraud, embezzlement, conflicts of interest, and sexual harassment cases. She has an extensive background with complex forensic reviews and eDiscovery. Additionally, Xiaoqian brings particular experience with post-investigation matters, guiding clients through disciplinary proceedings and assisting them in disputes arising from disciplinary actions.
Labor and Employment
- Assisted a global boutique consulting firm with applications for flexible working hours for a wide variety of consultants in Shanghai
- Advised a global technology company on a layoff and closure strategy at a production facility in Guangdong Province for 200 employees, resulting in mutual agreements for 100% of the population and no workplace disruptions, along with commendation on the process from the local labor authority
- Advised a US-listed software developer on managing restructuring and strategies for implementing employee terminations in China across three waves of layoffs
- Investigated misconduct and developed a strategy for handling dismissals of a group of employees at the Chinese subsidiaries of a global provider of commercial laundry systems
- Mediated an agreement to end a six-week strike by employees at a global industrial manufacturer’s joint venture facility
- Devised and implemented a strategy to dismiss three dispatched employees from a US trade association’s representative office and supervised 11 legal proceedings raised by the three employees; all rulings sustained the terminations of employment
- Advised an international industry association on the full lifecycle management of its China representative office, including establishment, internal policy development, recruitment, employee terminations, and deregistration
Compliance and Investigations
- Conducted an investigation into bribery allegations around regulatory approvals by a US-listed life sciences company’s personnel in China, including fast-paced, precise eDiscovery to uncover evidence surrounding the allegations and enable the client to take evidence-based disciplinary actions against responsible employees
- Conducted an investigation into allegations around a US-listed medical device company’s China subsidiary’s violation of relevant overtime laws and regulations in China; advising on disciplinary actions against responsible employees and remedial measures in this respect
- Collected and reviewed evidence for an investigation into sexual harassment and bribery allegations against a senior executive at a US-listed biotechnology company’s subsidiary in China and advised on disciplinary action against the senior executive
- Advised an international software company in an investigation of a breach of security and leak of confidential information due to employee misconduct
- Assisted a US-listed software company in investigating allegations of harassment, discrimination, and conflicts of interest involving side deals as a means to circumvent US export control laws
- Investigated whistleblower allegations of bribery, bid rigging, kickbacks, and retaliation at the Chinese subsidiary of a multinational healthcare company and advised on disciplinary and remediation measures for employees and third parties
- Assisted a global facilities service provider in investigating alleged bid rigging and potential bribery by three employees in China, advised on PRC and US compliance matters including the FCPA, and provided strategic guidance on remedial actions and disciplinary measures
- Conducted an internal investigation into 35 pending transactions for a US-headquartered manufacturer of scientific instruments and medical devices and advised on employment and compliance issues in order to process less risky transactions
- Investigated allegations from an anonymous whistleblower of corruption and self-dealing by current employees in connection with a government audit for a global facilities provider
