Morgan Lewis partner Grace Speights will moderate the panel "Dukes V. Walmart: What Can Employers Expect Next in Employment Class Action Litigation?" at the 2012 National Employment Law Council Annual Conference.

On June 20, 2011 in Dukes v. Walmart, the U.S. Supreme Court dealt a huge blow to plaintiffs seeking to certify employment discrimination class actions under Federal Rule of Civil Procedure 23, as well as consumer, antitrust, and other class actions. This panel discussion will address the legal implications of the Dukes decision for pending and future employment discrimination class actions and will provide strategies for employers on how to best prepare for the next wave of class action or multi-plaintiff litigation potentially flowing from the Dukes decision. The future potential of an increase in Equal Employment Opportunity Commission (EEOC) pattern and practice litigation will also be discussed.
