Endangered Species Act

The Endangered Species Act of 1973 (ESA; 16 U.S.C. § 1531 et seq.) is one of the most comprehensive and stringent environmental statutes. It is also one of the most litigated and the consequences of such litigation often have significant impacts on a myriad of businesses. With more than 300 listed species, California is home to more federally protected animals than any other state and is also the chosen venue for a significant portion of ESA litigation. Understanding the complexities of this ever-evolving area of law is critical to major sectors of California’s economy. In this presentation, Ella Foley Gannon will provide an overview of recent ESA litigation, identify key trends in this litigation, and discuss the impacts that these trends can have on California businesses.
