While much of the historical focus of the US Department of Justice and regulators in the False Claims Act (FCA) space has been on life sciences and healthcare, the broader landscape includes litigation exposure for several relevant industries, including technology/cybersecurity, defense, and financial services. The panel will explore the application of the FCA and the Anti-Kickback Statue in emerging industry contexts, with a focus on current circuit splits and other developing legal issues involving some key FCA defenses.
