Healthcare Fraud Enforcement Trends: Familiar Themes and New Areas of Scrutiny
Although the healthcare enforcement landscape continues to include the familiar themes we have seen in the past, recent US Department of Justice (DOJ) guidance, US Supreme Court decisions, and enforcement actions indicate that there will be new areas of scrutiny. Specifically, the session will focus on well-known anti-kickback trends and expectations for future enforcement, including the risks associated with the use of artificial intelligence and new technologies. False Claims Act developments will be discussed, including the Supreme Court’s recent decisions in the Schutte v. SuperValu and Proctor v. Safeway cases, risks associated with private equity investment in life science companies, and False Claims Act liability for cybersecurity failures. Finally, the session will cover pandemic-related enforcement actions and predictions for future trends.

Poached Chicken, Anyone? The Antitrust Division’s Prosecutorial Practices and Priorities Through the Lens of Recent Defense Victories
Utilizing the context of recent defense victories in US Department of Justice Antitrust Division broiler chicken and anti-poaching prosecutions, this program will spotlight the Division’s current approach to investigation, prosecutorial decision-making, and trial. We will discuss how the Leniency Program heavily impacts investigation and trial, and how the 2022 updates to the program create more uncertainty for those wishing to avail themselves of its protections. Various defense strategies that helped secure acquittals and dismissals in the highlighted cases will give white collar practitioners practical “take aways” in addition to an understanding of what to expect when clients face antitrust prosecution.
