Regulatory Ping Pong: DOL Releases Proposed Rule on Considering ESG Factors in ERISA Plan Investing, Practical Guidance

Partners Elizabeth Goldberg, Michael Richman, Julie Stapel, and Lance Dial, along with associates Rachel Mann and Gena Yoo, authored an article for Practical Guidance on a recent proposed regulation from the US Department of Labor. The rule—which would remove barriers to retirement plan fiduciaries’ ability to consider climate change and other environmental, social, and governance (ESG) factors when selecting investments and exercise shareholder rights—is the “most recent volley in a 25-year-long game of regulatory ping-pong with respect to the use of ESG factors in making investment decisions for ERISA plans.”
