The “threshold issue,” Levi said, is to what extent a network charging station owner selling energy will be regulated by state regulatory commissions. "If you're in a state where you're going to be regulated as a utility, or even as a 'utility-light,' it could raise some triggering obligations to seek certain certifications and permits to build your stations and operate them,” Levi shared.
