The team garnered a significant victory at the US Court of Appeals for the Federal Circuit, which paused the inter partes reviews of Nippon Shinyaku patents for the treatment of Duchenne muscular dystrophy (DMD) filed by Sarepta Therapeutics. The court ruled that Sarepta was obligated to bring its invalidity claims in Delaware federal court given a forum selection clause included in the agreement entered by both companies when they considered working together on DMD treatments, reversing a previous lower court ruling that denied Nippon Shinyaku’s request for an injunction.
