Partner Ron Dreben spoke to World IP Review about an upcoming joint study by the US Patent and Trademark Office (USPTO) and the US Copyright Office into the laws and policies surrounding non-fungible tokens (NFTs) and intellectual property (IP) rights. Ron said a top priority for the offices should be defining key terms, pointing to the confusion over what an NFT is and what an NFT owner has acquired.
“I think the USPTO and Copyright Office will hear many stories of harm to both IP and NFT owners, and one of the most helpful and practical things they could do would be to get everyone defining the key terms the same way,” Ron said.
