In the post, Julie summarizes a ruling from the US District Court for the Northern District of Texas that is in favor of the US Department of Labor and its authority to adopt the so-called “ESG rule.” Julie also notes that while the ESG rule has survived one court challenge, other potential hurdles remain.
“This decision may be appealed, and there is still another district court case yet to come, Braun v. Walsh, in the Eastern District of Wisconsin (filed in February 2023),” Julie wrote. “Members of Congress continue to seek to repeal the rule legislatively. As such, while there is no reasonable way to predict smooth sailing for the ESG rule, surviving this challenge is notable.”
