Partner Vishnu Shankar spoke with Legaltech News about lingering compliance questions with the EU AI Act. Vishnu – former head of legal (regulatory enforcement) at the UK Information Commissioner’s Office – pointed to ambiguity about the act’s grandfathering provision for general-purpose AI (GPAI) systems, particularly as it relates to system updates.
“[I]f you place a GPAI model on the market before Aug. 2, 2025, you have until Aug. 2, 2027, for compliance. But between those two dates, you make substantial modifications to a GPAI model,” Vishnu said. “And then you won’t lose the benefit of the grandfathering? Or will you lose the benefit of the grandfathering?”
