AmLaw Litigation Daily gave “shout-out” honors to a Morgan Lewis intellectual property litigation team made up of partners Ali Razai, Jason White, Benjamin Everton, Jacob Peterson, and Brandon Smith, for helping client lululemon fend off the last of three patents initially asserted in litigation by Nike in 2023.
Nike claimed lululemon’s inaugural shoe line infringed upon its technology covering textile manufacturing techniques for footwear but dropped infringement claims under one of the patents on the eve of trial this spring. In March, a jury found no infringement on one of the remaining patents and awarded Nike nominal damages on the final patent at issue, far below what had been sought. Then, in August, the US Patent Trial and Appeal Board invalidated the patent underlying the verdict, bringing the matter to a successful resolution.
