EPA Policy for PFAS Passive Receivers Faces Test Amid Dim Hill Outlook, Inside EPA

Inside EPA quoted partner Stephanie Feingold in an article about the Environmental Protection Agency’s (EPA) surprise decision to retain the Biden-era rule designating two legacy per- and polyfluoroalkyl substances (PFAS) as “hazardous substances” under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), also known as the Superfund law.

Stephanie told the publication she expects EPA’s decision to prompt an uptick in CERCLA claims, suggesting they “would include both existing claims that have been paused in recent months, as well as new claims by both private and public actors who have been waiting to see how EPA decided how it intended to proceed.”

The article also cited a September 2025 LawFlash written by Stephanie, partner Matthew Thurlow, and associate Drew Cleary Jordan analyzing EPA’s decision to retain the previous administration’s designation.
