Les Echos quoted partner Gilles Saint Marc in an article examining the delayed transposition of the AIFM 2 directive in France and its implications for private debt markets.

The article discusses how the delay is creating uncertainty for asset managers and limiting near-term access to the French market for certain foreign lending structures, even as other EU jurisdictions move forward.

Gilles noted that the lack of alignment may disadvantage France while leaving managers to navigate immediate application of certain technical rules. He noted that “the delay in transposition does not create a competitive advantage for asset management in France, since most other countries will already have implemented the text. It also opens a period of uncertainty for managers, as a number of technical standards are set out in delegated regulations and therefore apply immediately.”
