DOJ Making Big Push To Use AI To Suss Out Price-Fixing, Collusion, Corporate Counsel

Corporate Counsel quoted partner William McEnroe in an article about the US Department of Justice’s increasing use of artificial intelligence (AI) and data analytics tools to detect potential antitrust violations, including price-fixing and bid-rigging schemes.

William discussed how advances in AI are accelerating existing enforcement trends and creating new compliance considerations for companies, particularly in concentrated industries.

“I think it’s a continuation of what we’ve had, but it’s getting better and easier,” William said.

He also emphasized the importance of aligning compliance programs with evolving enforcement expectations and maintaining strong internal reporting cultures.

“Figuring out how to be an efficient business while avoiding tacit collusion that could be misinterpreted as express collusion is where folks should be thinking about where their compliance programs match up with the business realities,” he said.
