Lawyer: China Could Look to ‘Send a Message’ With Penalty Under Counter Sanctions Laws, Export Compliance Daily

Export Compliance Daily quoted partners Todd Liao and Carl Valenstein in an article about rising enforcement risks under China’s counter sanctions laws and the implications of the country’s new supply chain security rules for multinational companies.

Drawing on their comments from a recent Morgan Lewis webinar, the article included Todd’s comments on how Beijing’s expanding legal toolkit and increasing geopolitical tensions may heighten enforcement risks for companies navigating competing US and Chinese compliance obligations.

“Selective enforcement against high-profile targets is certainly a real possibility,” Todd said, adding that such actions could send a “message to the entire market.”

Carl highlighted the possibility that Chinese regulators could eventually issue FAQs or establish an advisory opinion process to provide companies with additional clarity around compliance expectations.
