Takeaways From the Rovirosa Reversal, Anti-Corruption Report

Anti-Corruption Report spoke with partner John Pease about the Southern District of Texas’s remarkable decision overturning a guilty verdict in a Foreign Corrupt Practices Act prosecution involving translated WhatsApp messages and alleged Confrontation Clause violations. John discussed the unusual evidentiary posture of the case.

“The thing that is extraordinary about this case is that there are no witnesses who testified who were party to those communications,” John said. “Typically, the prosecution has one co-conspirator who can explain the communications and provide admissible testimony about the existence of the conspiracy.” He added, “I would have to think that is an important part of the Court’s thinking in making its ruling.”
