Olivier discussed the importance of evaluating risk holistically and building protections into transaction documents, including host-government agreements, stabilization provisions, and force-majeure clauses. He also emphasized the need to account for local legal and regulatory frameworks and changing geopolitical conditions when structuring long-term investments.
Olivier stated, “Today’s geopolitical environment and the uncertainty it breeds can feel new, but it’s not, and the main thing is preparing and trusting that you have built in the right contractual provisions to protect investors.”
