Partners Matthew Miner and Eric Sitarchuk and associates Jaclyn Whittaker and Amanda Robinson contributed an article to the newsletter Corporate Governance Advisor regarding the updated resource guide issued by the US Department of Justice (DOJ) and US Securities and Exchange Commission (SEC) in July.
The authors noted that the latest revisions to A Resource Guide to the U.S. Foreign Corrupt Practices Act, which is heavily relied upon by practitioners, include a few noteworthy changes. Most notably, the Second Edition incorporates the Foreign Corrupt Practices Act (FCPA) Corporate Enforcement Policy, among other policies, for the first time. As before, the updated guidance continues to provide a detailed compilation of information about the FCPA, its provisions, and DOJ and SEC enforcement.
