The Effects of AIFMD 2 on Private Credit, Finascope

Partner Clément Vandevooghel and associate Agathe Llorens co-authored an article for Finascope examining the impact of AIFMD 2 on the private credit market and the evolving regulatory framework for alternative investment fund managers. The article explores how the revised directive introduces a more harmonised regime for loan-originating funds, including new requirements on risk management, leverage, and governance, as well as enhanced supervisory expectations across the European Union.

The authors explain that while AIFMD 2 brings greater legal certainty and supports the continued growth of private credit as an alternative financing source, it also increases operational and compliance obligations for fund managers. They highlight that firms will need to reassess their structures, policies, and cross-border strategies ahead of implementation, as the new framework reshapes how private credit funds originate and manage loans within the European Union.
