English High Court Ruling Marks Rare Successful Jurisdiction Challenge Under Section 67, Arbitration Act 1996, Mealey’s International Arbitration Report

Partner Robert Bolgar-Smith and associate Keir Baker co-authored an article for Mealey’s International Arbitration Report analyzing a recent English High Court decision that represented a rare instance of a successful jurisdictional challenge under Section 67 of the Arbitration Act 1996.

After outlining the factual background and legal framework underlying the judgment, the authors explain how it demonstrates that—notwithstanding the limited frequency of Section 67 challenges succeeding—the Court is willing to intervene where it is necessary to do so. The article also examines how the decision underscores the importance of raising jurisdictional arguments at an early stage, and the procedural hurdles that parties face should they fail to deploy those arguments promptly.
