Republic of Kazakhstan Updates Procedures for Establishing and Applying Quotas for Persons with Disabilities

Amendments to Kazakhstan’s Rules for Quoting Workplaces of Persons with Disabilities, effective as of 12 July 2026, will help strengthen automated control over compliance with certain of the Rules’ requirements by employers.

Article 107 of the Social Code of the Republic of Kazakhstan No. 224-VII dated 20 April 2023 provides for an obligation of employers to employ persons with disabilities within the quota established by local executive bodies of regions, cities of Republican significance, and the capital city.

The obligation is established for employers with a listed number of workers of 50 employees and above (excluding workplaces in heavy work and work with harmful and hazardous working conditions).

The quota for persons with disabilities is established as follows:

  • 50 to 100 employees: 2%
  • 101 to 250 employees: 3%
  • In all other cases (above 250 employees): 4%

The procedure for establishing and applying the quota is regulated by the Rules for Quoting Workplaces of Persons with Disabilities approved by Order of the Minister of Labor and Social Protection of the Population of the Republic of Kazakhstan No. 207 dated 7 June 2023 (the Rules).

Amendments have been made to the Rules, which entered into force on 12 July. The process now includes the sending of an automated notification to an employer through their personal account in the electronic labor exchange, with an obligation of the employer to send information on workplaces subject to the quotas (number of workplaces, professions, working conditions, and the amount of monthly remuneration).

At the same time, information on the fulfillment of the quota is generated automatically in the Labor Market system.

The introduced amendments are aimed at strengthening automated control over compliance with the relevant requirements by employers.
