Proposal Would Make It More Difficult to Permanently Replace Economic Strikers, HR Magazine

Partner John Ring is quoted in an article from  HR Magazine about a proposal from the general counsel for the National Labor Relations Board (NLRB) to change the standard for when employers can use permanent replacements for employees on economic strike—a term applied when employees are seeking things like higher wages, shorter hours, or better working conditions.

John, a former chairman of the NLRB, said if adopted, the proposal would make it harder for employers to meet the legitimate business justification standard needed to use permanent replacements.

"Employers confronting a potential strike should carefully consider the likely litigation risk and financial exposure involved in using permanent replacements," John said.
